Suspension recommended for lawyer in high-profile pot case

A Vermont Supreme Court disciplinary counsel is recommending a two-month license suspension for a Windsor lawyer whose marijuana arrest put her at the center of a public debate about drug laws.

The recommendation for Martha Davis now goes to a three-person panel of the Vermont Professional Responsibility Board, which could either accept or reject the recommendation.

Davis says she used marijuana to ease pain from migraine headaches and an inflammatory disorder in her arms and legs. 

The 61-year-old attorney and part-time judge was arrested last fall after game wardens found 2 and a half pounds of marijuana and 34 plants on her property.

Windsor County State’s Attorney Robert Sand reduced the charges and recommended her for court diversion. That move drew the ire of Governor Jim Douglas, who told State Police not to send major pot cases to Sand’s office. Douglas later backed down.
