Prosecutor wants man re-jailed after delay case

The Bennington County prosecutor is praising a U.S. Supreme Court decision that could result in a man who was released from prison last year being sent back to jail.

State’s Attorney Erica Marthage says she will file paperwork on Monday to have Michael Brillon re-arrested so he can continue the 12- to 20-year prison sentence that was interrupted a year ago when the Vermont Supreme Court ruled that delays in his case were unconstitutional.

On Monday the U.S. Supreme Court ruled the delays were attributable to him, not the state. It sent the case back to the Vermont Supreme Court.

Marthage says she’s never seen a case like this so she doesn’t know what’s going to happen.
