OMYA Makes Act 250 Appeal in Federal Court

A Vermont company has taken its appeal of an Act 250 land-use permit to a federal appeals court. OMYA Incorporated argues that Vermont is improperly restricting truck traffic on U.S. Route Seven.

An Act 250 permit limits OMYA to making 115 roundtrips per day between its Middlebury quarry and its calcium carbonate processing plant in Pittsford. OMYA already has exhausted its appeals of the permit before the Environmental Board and the Vermont Supreme Court. It also failed in arguments before U.S. District Court. So the company is now waiting for the judgment of the Second U.S. Circuit Court of Appeals.
