New Hampshire legislators will debate a proposed ban on smoking in cars with young passengers this week.

The bill’s critics say the state shouldn’t infringe on the adult drivers’ use of their private property. They say not smoking around children is common sense but should not be legislated.

Supporters of the bill say keeping children safe and protecting their civil rights trumps the rights of drivers. They say children have no defense against second-hand smoke in confined places.

The bill comes before the House this week.
