Legal scholars offer views on troop deployment bill

A Harvard law professor says it would be hard for the state of Vermont to win a legal argument that it should be able to bring its National Guard troops home from Iraq.

David Barron testified yesterday before the Senate General Affairs and Economic Development Committee, which is taking testimony on a bill that would authorize Gov. Jim Douglas to order that Vermont National Guard troops be brought home from Iraq.

Supporters of the proposal say the main reasons given for the war when Congress authorized President Bush to pursue the war in 2002 no longer exist because no weapons of mass destruction have been found and Saddam Hussein is dead.

But Barron says that since Congress is continuing to fund the war, the authorization is still in effect.
