Judge To Weigh Contempt Citation In Custody Battle

A Vermont judge is expected to decide today whether to issue a contempt citation to a Virginia woman who has defied a court order to surrender the 7-year-old girl she had with her former partner.

Rutland Family Court Judge William Cohen is being asked by attorneys for Janet Jenkins, of Fair Haven, to hold in contempt Lisa Miller, of Forest, Virginia, who failed to surrender Isabella Miller-Jenkins on Jan. 1 as ordered.

Jenkins’ attorney also wants a court to compel authorities to find Miller, the birth mother, whose whereabouts are unknown.

Miller and Jenkins got a civil union in 2000, but they broke up later and Miller renounced homosexuality.

Courts in Virginia and Vermont have ruled in favor of Jenkins, even though she is not the biological mother.
