Judge limits scope of killer’s appeal

A judge is limiting the scope of an appeal filed by a man convicted in the 1997 killing of his wife.

Herman Yoh, 52, of Colchester, who’s serving life in prison, wants his conviction overturned because he says his defense attorney was ineffective.

Prosecutors have asked Superior Court Judge Matthew Katz to dismiss Yoh’s revised appeal because it expands the claims reinstated by the high court. This week, Judge Matthew Katz agreed with prosecutors, throwing out aspects of Yoh’s argument.

The judge barred Yoh’s lawyers from raising claims about the vigor of his former lawyer’s attack on the state’s case and about whether he objected properly to a decision preventing the jury from returning a manslaughter verdict.
