The attorney for fired Brattleboro Police Chief John Martin says the town select board had its mind made up to fire him before a disciplinary hearing on the matter was held.

Attorney Pietro Lynn says it was not a fair and impartial hearing.

The town announced the decision to fire Martin on Wednesday. A report by a consultant hired the town criticized Martin’s leadership. A majority of the select board called the police department "dysfunctional.”

Martin was also accused of not providing accurate information about his knowledge and leadership on a July incident in which two peaceful protesters were shocked with a Taser.

Lynn says the officers disobeyed ordered when they shocked the protesters.
