A judge in Concord, New Hampshire is scheduled to hear arguments tomorrow in the state’s motion to dismiss a lawsuit filed by the operators of the Mount Sunapee ski resort.

Tim and Diane Mueller, operators of the resort, claim that Governor John Lynch has violated their lease agreement by refusing to consider their plan to expand. The state has leased the land to the Muellers for ten years.

Lynch says it’s not in the state’s best interest to give permission for the Muellers to change the ski area lease to facilitate condominium development on nearby private land.

Arguments are scheduled in Merrimack County Superior Court.
