Appeal could determine land-use permit limits

An appeal pending before the Vermont Supreme Court could help to determine the limits of a three-year-old reform of the state’s land-use permit system.

The court is expected to rule soon on a case involving a Clarendon quarry. Neighbors appealed last year after J.P. Carrara and Sons Incorporated won a permit to expand its dolomite quarry.

The question for the Supreme Court is whether the expansion should be allowed to proceed while justices decide the appeal.
Lawyers say the decision will be key in how the permit reform law is working.

It was designed to speed land-use appeals and Carrara’s lawyer says that means the expansion should go forward.

Lawyers for the neighbors say the expansion should be put off until the appeal is resolved.
